10. ORDER
When placing an orderthrough the website, you certify and expressly declare that:
Your order constitutesa purchase proposal and only becomes binding when expressly accepted by Nestléthrough the sending of an email confirming the same. Upon receiving your order,you must sign the delivery note. By signing the delivery note, you declare, forall intents and purposes, that you are providing your written consent regardingthe order you have placed. Bulk orders made by commercial or consumer groupswill not be accepted. The items will remain the property of Nestlé until theyare fully paid for. Upon delivery, the responsibility for the item passes tothe recipient.
All products featuredon the website are subject to availability in stock at the time the product iscollected. If any product is unavailable, it will not be invoiced, and theamount will be refunded within 48 business hours.
11. VALUE
The items featured on this website are available for sale at the pricesindicated in euros. The prices shown include IVA at the current legal rate. The minimum order value for the online store is 20 euros, and the shipping costs are free for orders equal to or above 80 euros. For orders below 80 euros, the shipping costs will be calculated based on the weight of the order and delivered throughout the mainland Portugal territory, including the islands. Products are subject to availability in thewarehouse and prevailing market conditions. In the event that an item is notavailable, this information will be displayed on the website. If an unforeseenstock shortage occurs after the order is placed, you will be duly informed.
12. PAYMENT METHODS
Payments can be made using the following methods: MBway payment, and Visa or Mastercard credit card payment. Your order will only be processed upon successful payment. For Visa or Mastercard credit card payments, payment confirmation will be made upon delivery confirmation. Nestlé reserves the right to cancel the order if payment is not authorized or if there are doubts about its successful collection.
13. DELIVERY
Home Delivery and CTT Pickup Points
Delivery will be made to the delivery address or collection point you select, provided that it is within the territory of mainland Portugal and the islands (Azores and Madeira archipelagos). The system automatically assumes your profile address for this purpose. However, during the ordering process, in the 'delivery' step, you can edit this address or even add an alternative address. After payment confirmation, your order will be delivered:
• Mainland Portugal: maximum period of 3 working days;
• Madeira: Ships depart on Tuesdays and Fridays from Mainland Portugal. Transit time (Funchal) - 5 working days;
• Azores: Ships depart on Fridays from Mainland Portugal bound for São Miguel and Terceira. The other islands depend on inter-island connections, meaning all orders depart on the Friday ship but await corresponding connections in São Miguel and/or Terceira. Transit time - 7 to 10 working days (São Miguel and Terceira), while the other islands may take up to 9 to 15 working days.
You will receive 2 communications: the first indicating the dispatch of your order for distribution the next day, until 6:00 PM, and the second specifying the 1-hour interval for the delivery. In the case of collection points, you will be informed when your order is available for pickup at the selected point.
All the above-mentioned communications regarding the delivery of your order will occur via email or SMS (we suggest that you keep both duly updated in your profile and in your delivery details, which you can update at the time of purchase). It is your responsibility to ensure that you will be available on the day of delivery of the order. After two delivery attempts, the products will be returned. From that moment on, if there is still interest in receiving the product, you will have to reorder from our Online Store.
Click & Collect Lockers Collection (Locky lockers at the Headquarters)
Delivery will be made to the Locky lockers, available at the Linda-a-Velha Headquarters, on the -1 floor (next to the General Services). For orders placed by 1:00 PM, the collection will be available for pickup on the same day, during the afternoon. For orders placed after this time, the collection will be available on the next working day. When the order is available for collection, you will receive a notification by email/SMS with the code to use for opening the door.
From the moment you receive the collection notification, you will have 5 days to pick it up – after this period, the order will be canceled.
14. CONTRACT TERMINATION
The consumer has the right to withdraw from thiscontract within 14 calendar days, without the need to provide any reason. Thewithdrawal period will expire 14 days from the day following the day on whichyou, or a third party designated by you, other than the carrier, physicallyacquire possession of the goods. To exercise your right of withdrawal, you mustinform us via email at loja.lisboa@pt.nestle.com or by letter to the address Rua Alexandre Herculano, 8, 2799-554Linda-a-Velha of your decision to withdraw from this contract through anunequivocal statement. You may use the withdrawal form model provided inDecree-Law No. 24/2014, dated February 14, but this is not mandatory. To meetthe withdrawal deadline, it is sufficient that your communication concerningthe exercise of the right of withdrawal is sent before the withdrawal periodexpires.
In the event of withdrawal from this contract, we willrefund all payments received from you, including delivery costs (with theexception of supplementary costs resulting from your choice of a deliverymethod other than the least expensive standard delivery offered by us), withoutundue delay and, in any case, no later than 14 days from the day on which weare informed of your decision to withdraw from this contract. We will carry outsuch refunds using the same means of payment as you used for the initialtransaction unless you have expressly agreed otherwise; in any event, you willnot incur any fees as a result of such refund. We will collect the goods, andyou will bear the direct cost of returning the goods. The consumer isresponsible for any diminished value of the goods resulting from the handlingof the goods other than what is necessary to establish the nature,characteristics, and functioning of the goods. 15. SPECIAL OFFERS,PROMOTIONS, AND CONTESTS
Periodically and in accordance with the promotions in effect, the purchaseof products may be subject to special offers. The pricesand promotions applied to the products in your order will be those indicated onthe website at the time of your purchase, regardless of any offers orpromotions in effect on the day of delivery of the order.
